These Terms and Conditions (“Terms”) form a legal agreement between BAWDY by Row (“BBR”) and you, the individual, (“you” and “your”) concerning your access to and use of the various services offered through the Website. By using the Website, you expressly agree to these Terms. If you do not agree to these Terms, you should immediately cease all use of and access to the Website. Please print a copy of these Terms for your records.

Waiver of Liability

By using this Website, purchasing, and participating in the offered programs, you agree that you are at least 18 years of age and demonstrate that you understand that there is a risk of physical injury; visitors under the age of 18 are strictly prohibited from using the Website. By participating in the offered programs, you agree that you do so at your own risk and discharge BBR, and its owner, Rowena McDonald, from any and all legal claims and actions. NEITHER BBR NOR ITS OWNER, ROWENA MCDONALD, ARE LIABLE FOR ANY INJURIES THAT MAY RESULT FROM THE USE OF THE OFFERED PROGRAMS.

By purchasing and participating in the offered programs you agree and acknowledge that the nutritional information provided in the offered programs is offered as a loose guide and intended only for educational purposes, not as a prescribed diet. Neither BBR nor Rowena McDonald are authorized to provide meal/diet plans. Neither BBR nor Rowena McDonald are liable for any agitation or exacerbation of your existing medical conditions; you are personally responsible for receiving medical clearance from a licensed physician before participating in the offered programs.

To the maximum extent permitted by applicable law, in no event shall BBR or its owner, Rowena McDonald, be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Website, third-party software and/or third-party hardware used with the Website, or otherwise in connection with any provision of this Terms), even if BBR has been advised of the possibility of such damages and
even if the remedy fails of its essential purpose.

Access and Termination

In order to use the offered programs, you will be asked to register an account and create login information, including without limitation, username and passwords. When you create an account with BBR, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account. You must safeguard your login information that you use to access the Website and you must not disclose this information to anyone. The sharing of a registered account will result in termination of the account and its privileges. SHARING AN ACCOUNT OR DISTRIBUTING PROGRAM CONTENTS VIA ANY MEDIUM IS STRICTLY PROHIBITED.

BBR may, in its sole discretion, terminate your access to the Website, or any portion thereof, for any reason whatsoever without prior notice. These actions are in addition to any other right or remedy BBR may have available at law. Further, BBR shall not be liable to you or any third party for any such termination or discontinuance. You may terminate these Terms by ceasing to access and use the Website. Upon any termination of these Terms you must immediately cease use of the Website.

Prices Policy

BBR reserves the right to revise its prices at any time prior to accepting an order. In this event you will have the right to cancel your order.

Payment

If you wish to place an order for products available on the Website, you may be asked to supply certain information relevant to your order including, without limitation, your name, your email, your phone number, your credit card number, the expiration date of your credit card, your billing address, and your shipping information. You represent and warrant that: (i) you have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any order; and that (ii) the information you supply to BBR is true, correct and complete. By submitting such information, you grant BBR the right to provide the information to payment processing third parties for purposes of facilitating the completion of your order. Payment cards (credit cards or debit cards) are subject to validation checks and authorization by your card issuer. If BBR does not receive the required authorization, BBR will not be liable for any delay or non-delivery of your order.

Order Cancellation

BBR reserves the right to not accept or process orders that do not comply with its business policies. Any products you purchase can only be returned or refunded in accordance with the Return Policy below.

Intellectual Property

The Website and its original content (including the offered programs), features and functionality are and will remain the exclusive property of BBR and its licensors.

Dispute Resolution

If you have any concern or dispute about the Website or products provided, you agree to first try to resolve the dispute informally by contacting BBR.

Changes to the Terms

BBR may in its sole discretion, without prior notice to you, revise these Terms at any time. Should these Terms change materially, BBR will update the Effective Date noted below and post a notice regarding the updated Terms on the Website. If you do not agree to the terms of the amended Terms, your sole and exclusive remedy is to discontinue your use of the Website and you will be deemed to have terminated these Terms. Amended Terms will be effective as of the Effective Date unless otherwise stated. By accessing or using the Website after such changes are posted you agree and consent to all such changes.
